These terms and conditions govern your use of the Food Local Food.com website (Food Local Food.com Site) & all written material, such as the foodlocalfood catalogue and your relationship with Food Local Food.com. Please read them carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms and Conditions, please do not use the Food Local Food.com Site.
The Food Local Food.com Site & Catalogue is provided to you free of charge for your personal use subject to these Terms and Conditions. By using the Food Local Food.com Site you agree to be bound by these Terms and Conditions.
All orders and purchases made on the Food Local Food.com Site or by Catalogue will also be governed by the following Product Terms.
Please note that where indicated the prices on our website are guide prices only. The actual price you pay will be the price charged when the goods are dispatched. We use a variety of local suppliers to source some of our products and they can be small producers and thus prices can be different between producers and can also change week to week. The actual order value cannot be determined until the day of delivery because the prices stated on the website may vary either above or below the prices charges by suppliers on the day your order is picked and delivered.
All prices are expressed inclusive of any VAT payable unless otherwise stated.
When your order is delivered you may return any item and receive a full refund immediately if you consider that the difference between the price charged and the guide price shown on the website is unacceptable.
Availability
If for any reason beyond our reasonable control, we are unable to supply a particular item, we will not be liable to you. Please note that we will attempt to deliver substitute lines should selected lines be unavailable unless you request us not to do so.
Although we will always try to cater for your orders, an order of large quantities of a line can only be fulfilled at the discretion of the supplier for example, if you were to make an order of 20 bottles of wine which would use up all that suppliers stock, Foodlocalfood.com may only deliver 10 bottles.
If our substitute items are not acceptable we will refund immediately the cost of that item.
Acceptance
There will be no contract of any kind between you and us unless and until we actually dispatch the goods to you. Your order is an offer to buy from us. Nothing that we do or say will amount to any acceptance of that offer until we actually dispatch the goods to you. At any point up until then, we may decline to supply the goods to you without giving any reason. At the moment that the goods are dispatched (and not before), a contract will be made between you and us, and you will be charged for the goods.
Delivery will be made to the address specified by you on the completed order form.
We will deliver your order to the main entrance of the delivery address. At your request, our driver may carry your order into the delivery address, for example, to a particular floor in an apartment block or into your kitchen but only if: a. the driver has your permission and b. our driver believes that it is safe and practical to do as you request. We always reserve the right to deliver only to the main entrance of the delivery address.
Please note that we deliver goods only to specified towns and villages within the North East of England. To check that foodlocalfood.com delivers to your area, please check the site before you order. If you are outside our area please check to see if we can courier a service to you. There is an opportunity to register where you live so we can build up a profile of the best area to expand into.
Delivery times will be agreed with you at the time of placing your order or within 24 hours of delivering the order.
The Food Local Food Team follows a "Think 21" policy, so if the person receiving the goods looks under 21, proof of age will be requested. If proof is not available and there is no-one of that age at the address when delivery is being made, the goods may be retained by the driver. If we attempt to deliver your order to the delivery address as arranged with you but there is nobody at the delivery address to accept your order, the driver will leave notification of attempted delivery and you will need to contact our Customer Service Centre to re-arrange delivery (see below for contact details).
In these circumstances, if we have to return to deliver the goods, a further charge may become payable provided that delivery is attempted at the agreed time.
Whilst we make every effort to deliver all your goods in the agreed time, we will not be liable if we fail to do so in part or in full due to circumstances beyond our control.
Returns of non-perishable items
We hope you will be happy with your purchase. However, should you feel it necessary to return an item, we aim to make the returns process as simple as possible.
If you are unhappy with any non-perishable items, simply return then to Food Local Food in the original packaging within 14 days of despatch and we will give you a refund on those products or replace the item. Your statutory rights are not affected.
Cancellation
You can cancel or change any of your current orders up to 10;30AM Wednesday the week of your delivery. You can do this calling Customer Services on 08450948587. Please note that orders cannot be cancelled by email.
Payment
You can pay by any American Express, Mastercard or Visa credit card, Maestro or Delta debit card. We do not currently accept Visa Electron cards. Authority for payment must be given at the time of placing your order. You will not be charged for items until they are dispatched.
Our liability to you in connection with any order will not exceed the total price charged for the relevant items. All orders are though a secure connection managed by Google checkout or World Pay.
These Product Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.
If any of these Product Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms which will continue to be valid and enforceable to the fullest extent permitted by law.

Amendments
We may update these Terms and Conditions from time to time and any changes will be notified to you via a suitable announcement on the Food Local Food.com Site. If you do not wish to accept the new Terms and Conditions you should not continue to use the Food Local Food.com Site. If you continue to use the Food Local Food.com Site after the date on which the change comes into effect, your use of the Food Local Food.com Site indicates your agreement to be bound by the new Terms and Conditions.
Minimum Spend Requirements
As Foodlocalfood is delivering and working with multiple small producers we are asking for a £15.00 minimum spend per order. Please ring us if your order falls under this amount and we will check if items can couriered or if you are on an existing delivery route.
Limitations
You may not use the Food Local Food.com Site for any of the following purposes:
You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlements sums paid by us as a result of any settlement agreed by us arising out or in connection with:
Although Food Local Food.com aims to offer you the best service possible, Food Local Food.com makes no promise that the services at the Food Local Food.com Site will meet your requirements. Food Local Food.com cannot guarantee that the service will be fault free. If a fault occurs in the service you should report it to Customer Services and we will attempt to correct the fault as soon as we reasonably can.
Your access to the Food Local Food.com Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. Food Local Food.com will attempt to restore the service as soon as it reasonably can.
